Well, five and a half months ago I was travelling home from a friends house at 11:30 at night through Rugby town centre. At some lights a bunch of lads in a white escort flashed me and pulled up behind all looking intently at the car (an Evo 6 GSR).

I continued through rugby town centre (Not hanging around, and on national speed limit roads), noticing some light behind, but not directly behind - more like 100m. I noticed this particular car following me all the way to the A5 (From the A426), then follow me west on the A5. I then became concerned I was being followed so initially slowed down to around 60mph (On a 70mph road) to see if the car would catch up from this strange 100m distance - it didn't. I then speeded up to about 90mph to see what would happen - low and behold it maintained this peculiar distance. As I then approached a section of dual-carriageway I made the mistake of accelerating off to put a car which I noticed ahead of me in between me and the car behind before the section of dual carriageway came to and end, and the road went to single lane again. The idea being that this car would then be forced to overtake this car to stay behind me (Since then the road had gone down to 1 lane again), so I would then definitely know someone was following me home, and take whatever action was necessary.

So, as I accelerated to go past the car on the dual carriageway the blue lights came on, and I realised it was a police car. They have got me on VASCAR video at (Cough) well over the speed limit of 70mph.

What I'd like you guys to help me with is instances of where you know of people who have had their EVO's stolen from their homes buy people following them home, or the so called 'Carjack' method, so I can take this into court and show the magistrates the reason why I sped off at high speed - to protect me and the car from what I thought was somebody following me.

Were the 'lads' in the white Escort the rozzers?

Also take a good specialist solicitor (well worth £2-500)

Carjacking is big news today, watch tonight news, a gang went on the rampage in London last night breaking into houses pushing guns in peoples faces at 3 in the morning. My missus is quite scared about this, especially with a 1 year old baby in the house.

Paul, I don't know how you will get hold of it or even if you can but if the Escort came up behind, flashed its lights and followed you in Rugby town centre, it may have been captured on CCTV. If you get a solicitor involved he may be able to use it.

Just a thought.

Contact Rugby council and ask you has the contract for the CCTV, then ask the people who run it to give you a tape of your car, if they have it. They have to do this my law and there is a minum fee. If yur were to do this I would do it sooner rather than later as the tapes may get wiped.
To be honest it sounds like entrapment to me, ie they set you up to catch you speeding. When they show the video from the police car in court you can explain that you were speeding up and slowing down to assess what the behond car was doing., ie possible car jacking. If the offices say they were following you cause they thought you were dodgy they should have pulled you up then and not later. They shouldnt have pulled you on a dual carriageway due to you being able to get away, plus they were putting the indiviuals in the other car on the dual carriage way in danger. I would ask what experince the policeman has in reagards to driving high speed cars and the last time he was checked. The biggest problem you will have is that the police will do everything to discredit you in court, they may also show the bits of video they want the court to see.
Personally I think you did the right thing and I would do exacty the same thing again if it happened to me.

While I agree that the courts should be extremely lenient in this situation it isn't entrapment. Entrapment is when you entice someone to commit a crime they would not otherwise contemplate committing. In this instance Paul was only more than willing to break the speed limit in that situation, as I think all of us would TBH. If the cops had any decency they should have accepted a road-side explanation of the incident and not taken any further action. They must realise that people will do these things if they think they are being followed.

True, but just cause you drive a fast car dosnt mean you will break the law. Just because someone has a gun or a knife dosnt automatically mean they will kill someone.
I would just say then that the police created a situation where they forced someone to break the law, which may not come under the legal definition of emtapment, but comes somewhere near it.

Just a point for everyone,if you get stopped by traffic,after you are cautioned always ask if they have had there equipment calibrated that day.More times than enough they dont.If they did have it calibrated they need to produce a certificate to prove it.If they cant the evidence is inadmissable,and the case should be dismissed.

I did this when I was last pulled,by an officer parked on the side of a road with an electronic stopwatch,timing me over a given distance.He said I was doing 97 in a 60,it was a dual carrigeway, I had a good barrister and the case was dismissed and I got costs .The officer was grilled by my barrister for
2 hours in the box,I never even had to give evidence,it was one of the best days of my life.

I recommend The Drivers Survival Handbook it saved my licence has really good stuff in it.

another one to try. If a gatso gets you, ask to see statements from everyone involved, including the person loading, and unloading the camera and developing the film. Not sure if Gatso's have to be callibrated, but it's worth trying to ask for a cal cert on these as well. It's all part of PACE, that evidence must have continuity (i.e. can't have been tampered with). If they can't provide this, you should be able to get it thrown out of court. If you are switched on enough, magistartes like people who represent themselves, and give them far more lee way than solicitors.

I have to disagree on that. Just cos you think you are being followed does not mean you *have* to break the law. The correct procedure is to drive to the nearest police station if you think you are being followed (or a built-up, well populated area). If the car is unmarked (or even marked) then going right around a roundabout a few times will let you know if you're being followed.

Yep - Gatsos do have to be calibrated and they have to show you the calibration certificate if you ask to see it (good one to try as most of them are out of date) :)

cant be bothered arguring any more about this.
But it often depends what your doing and if you have time and the knowlegde to get out of an area.I take all precautions not to get followed, but in some situations breaking the law is a nessasity.
And for f|PLS|cks if your not breaking the law 70% of the time when you driving get a robin reliant.

bring the performance of the car in to the court
ie stops in so many metres because or extra large brakes
out handles other cars because of race/rally suspension .
tell them at 30 mph the car stops in A 60mph in B
so the car is built to speed safely because it is so special 1 OF 500 TELL THEM
