Interesting find, not that I'm surprised really as it seem that everything that we think will own can always be taking away from us if they really what too.

Not just the moon, but also the non-atmospheric "space" directly above a country doesn't count as belonging to that country, and is treated entirely different to the territorial (atmospheric) airspace above and within that country's recognised borders (plus a 12 nautical mile buffer for coastal areas, outside of which is deemed as "high seas airspace"). This is why orbital satellites have absolutely free reign to pass over any other country during orbit - which freely include spy satellites...
